1. Acceptance of Terms
By accessing and using QuoteKarma, you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service. We reserve the right to update these terms at any time. Your continued use of QuoteKarma following the posting of revised terms means you accept and agree to the changes.
2. Description of Service
QuoteKarma is a consumer web application that analyzes contractor quotes for solar, roofing, and HVAC home improvement projects. The service provides the following features: quote scoring and analysis based on regional market data; identification of red flags in contractor proposals; market positioning analysis showing how your quote compares to other quotes in your area; negotiation playbooks and talking points; professional PDF reports summarizing analysis; multi-quote comparison tools; and community benchmarking data derived from aggregated, anonymized quotes. QuoteKarma is designed to help California homeowners understand if they are receiving fair pricing and to support informed decision-making about home improvement projects.
3. User Accounts
To use QuoteKarma, you must create a free account. You may register using Google single sign-on (SSO) or other authentication methods we provide. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update this information as needed. You are solely responsible for any activity that occurs under your account, whether or not you authorized it. You must notify us immediately of any unauthorized use of your account. QuoteKarma reserves the right to terminate your account at any time for violations of these terms or for any reason at our sole discretion. Upon termination, your right to use the service ceases immediately.
4. Acceptable Use
You agree to use QuoteKarma only for lawful purposes and in ways that do not infringe upon the rights of others or restrict their use and enjoyment of the service. Your use is restricted to personal, non-commercial purposes. Prohibited behavior includes harassing or causing distress or inconvenience to any person; offending the sensibilities of any person; disrupting the normal flow of dialogue within our web pages; intentionally or unintentionally violating any applicable local, state, national, or international law; and collecting or tracking personal information of others. Additionally, you agree not to: scrape, crawl, or use automated tools to access or extract data from QuoteKarma; impersonate any person or entity; manipulate or artificially inflate analyses or scores; or interfere with the normal operation of the service.
5. Quote Data & Privacy
You retain full ownership of all quote data and personal information you upload to QuoteKarma. You grant QuoteKarma a license to use your quote data for analysis and service provision. QuoteKarma may use anonymized and aggregated quote data (stripped of personally identifiable information including names, addresses, email addresses, phone numbers, and any other data that could identify you or your contractor) to generate community benchmarks, market insights, and to improve our service algorithms. This anonymized data may be used for statistical analysis and trend identification. Your personal information will never be shared or sold to third parties. All quote data is encrypted both in transit (via HTTPS/TLS) and at rest (via encryption at storage). 6. Analysis Disclaimer
QuoteKarma analyses and scoring are provided for informational purposes only. They are not professional advice, and we do not make any representations or warranties regarding the accuracy, completeness, or reliability of our analyses. You should always verify information with licensed professionals such as contractors, electricians, or engineers before making any decisions based on our analysis. QuoteKarma does not guarantee that you will achieve any particular savings, financial benefits, or outcomes based on our analysis. Market data presented is based on historical quotes from 2023-2024 and may not reflect current market prices, regional variations, or project-specific conditions. Pricing can vary significantly based on factors including but not limited to: specific property conditions, contractor experience and licensing, material selections, labor market fluctuations, and local economic conditions. You use QuoteKarma analyses at your own risk and are solely responsible for all decisions you make based on that analysis.
7. Intellectual Property
QuoteKarma owns all intellectual property rights in the service, including but not limited to: all algorithms, scoring methodologies, analyses, reports, design elements, code, graphics, and other content. All user-generated content and analyses remain the property of QuoteKarma. You are granted a limited, non-exclusive, non-transferable license to use QuoteKarma reports and analyses for your personal, non-commercial use only. You may not copy, modify, publish, broadcast, transmit, distribute, perform, display, or sell any content from QuoteKarma without our prior written permission. All rights not expressly granted are reserved.
8. Third-Party Services
QuoteKarma uses third-party services including Stripe for payment processing, Supabase for authentication and data management, and may provide links to the California Contractors State License Board (CSLB) for license verification. QuoteKarma is not responsible for the availability, accuracy, or reliability of these third-party services. Your use of third-party services is governed by their respective terms of service and privacy policies. We recommend you review the terms and privacy policies of any third-party services before using them. QuoteKarma disclaims all liability for any issues, errors, or damages arising from your use of third-party services.
9. Limitation of Liability
To the fullest extent permitted by law, QuoteKarma and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if advised of the possibility of such damages. QuoteKarma's total liability to you shall not exceed the amount you paid to QuoteKarma in the twelve months preceding the claim, or one hundred dollars, whichever is less. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so this limitation may not apply to you. QuoteKarma makes no representations or warranties that the service will be uninterrupted, error-free, or secure. The service is provided on an "as-is" basis. QuoteKarma is not liable for any decisions you make, actions you take, or financial outcomes you experience based on analyses provided by QuoteKarma.
10. Indemnification
You agree to indemnify, defend, and hold harmless QuoteKarma and its owners, employees, agents, and successors from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of QuoteKarma; your violation of these terms; your violation of any applicable law or regulation; your infringement of any intellectual property rights; or any content you provide or upload. This indemnity shall apply regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory.
11. Modifications to Service & Terms
QuoteKarma reserves the right to modify, suspend, or discontinue the service (or any part thereof) at any time with or without notice. QuoteKarma may also modify these Terms of Service at any time. Changes will be effective immediately upon posting to the service. We will notify you of significant changes via email to your registered email address or through a prominent notice on the service. Your continued use of QuoteKarma after any such modification constitutes your acceptance of the modified terms. If you do not agree to the modified terms, your only remedy is to cease use of the service.
12. Governing Law
These Terms of Service and your use of QuoteKarma shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of the state and federal courts located in California for any disputes arising out of these terms or your use of QuoteKarma.
